　　《最高人民法院关于破产清算组在履行职责过程中违约或侵权等民事纠纷案件诉讼管辖问题的批复》已于2004年6月17日由最高人民法院审判委员会第1317次会议通过。现予公布，自2004年6月28日起施行。

湖北省高级人民法院：

你院鄂高法[2003]383号《关于破产清算组在履行职责过程中违约或侵权等民事纠纷案件诉讼管辖问题的请示》收悉。经研究，答复如下：

企业被宣告破产后，清算组因履行清算职责对他人违约或者侵权引起的民事诉讼，发生在破产程序终结之前的，由受理破产案件的人民法院管辖，在破产程序中一并处理。

The “Official Reply of the Supreme People’s Court on the Issue concerning the Jurisdiction of Litigation of Civil Dispute Cases of Breach of Contract or Infringement by Bankrupt Liquidation Groups in their Performance of Duties”, which was adopted at the 1317th meeting of the judicial committee of the Supreme People’s Court on June 17, 2004, is hereby promulgated, and shall come into force as of June 28, 2004.

The Higher People’s Court of Hubei Province,

Your Request for Instruction on Issues concerning the Jurisdiction of Litigation of Civil Dispute Cases of Breach or Infringement by Bankrupt Liquidation Groups in their Performance of Duties (No.383 [2003] of Hubei Higher People’s Court) has been received. We hereby give the following reply upon deliberation:

Where, after an enterprise has been adjudicated bankrupt, a civil litigation, which results from the breach of contract to of infringement on others by liquidation groups due to their performance of liquidation duties, shall be subject to the jurisdiction of the people’s court accepting the bankruptcy case, and shall be handled in the bankruptcy procedures together.
